Parties to the contract:

The contract is between you (The Buyer) and www.OzFlatPacks.com.au (The Seller). The goods shall be the products supplied by the seller to the buyer according to these terms and conditions.

Terms of Use

By using the www.OzFlatPacks.com.au website, you agree:

a) That the information is only to be used as a guide to the products and services offered by www.OzFlatPacks.com.au;

b) Any one or more of the products listed as available, may not be available from time to time;

c) You make the acknowledgements listed below.

 

Descriptions, prices and product information:

We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. If there is anything which you do not understand or if you wish to obtain further information, please email us at [email protected]. If by mistake we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before the deposit is paid. In these circumstances, we will notify you of the correct price so you can decide whether or not you wish to proceed with the order process. All prices are expressed inclusive of any GST payable unless otherwise stated.
 

Acknowledgements

By using this website, you acknowledge that:

After this time, you cannot amend your order. Your order is an offer to buy from us. Acceptance of this offer will take place on receipt of deposit payment.
 

Product guidelines

www.OzFlatPacks.com.au endeavours to source only the highest quality hardware and materials for use in the manufacture of our custom flat packs. If you are not satisfied with the quality of the hardware or material used, please let us know and we will investigate further.

Alterations to the Terms & Conditions

www.OzFlatPacks.com.au reserves the right to change the terms and conditions applicable to the website, or to impose new terms and conditions. Such modifications or additions shall be effective immediately upon notice to each client. Notice may be given by any reasonable means including, but not limited to, posting a revised version of this Agreement on the Internet or notification by electronic mail.

Any use of the Site after such notice shall conclusively be deemed to constitute acceptance by you of such modifications, additions, or deletions. You have the responsibility to periodically review the posted terms and conditions to be aware of such revisions.

 

Delivery:

Delivery will be made to the address specified when the order is complete and after the final invoiced amount has been paid in full. We advise that you take out insurance on your freight. We can not be held responsible for any direct or indirect expenses caused due to late delivery. We make every effort to deliver all your items within the specified period set and we will always do everything within our power to keep to a delivery date, but there may be circumstances beyond our control that cause delays. We shall contact you to let you know if we are having any problems getting a delivery to you within that time. Late delivery does not constitute a reason for the buyer to cancel the contract or refuse or delay payment. We also reserve the right to deliver the goods in more than one visit when deemed necessary. You must be present to receive the delivery. Once you have received the goods, risk of damage to, or loss of the items, passes to you. Ownership of the goods remains with www.OzFlatPacks.com.au until payment in full has been made by you and received by us. We advise you to inspect the goods upon delivery. If any items were lost or damaged in transit, we ask that you report it to us within 3 working days of delivery. Any claims submitted after this period will not be accepted. For full information about our lost/damaged goods returns policy, please see section "Faulty / lost / damaged items" below. 

 

Cancellation of order:

As we manufacture all our cabinetry to your specific requirements, once you place the deposit for the order, the order is deemed underway and can't be cancelled, and the deposit cannot be refunded, so please double check all the details before paying the deposit.

 

Assembly / Installation:

We do not offer an assembly or installation service, nor do we accept any responsibility for works carried out by a third party assembly/installation service or any other trades. All liability for the selection of these trades falls with you, the buyer. Before working with electricity, gas or water, you should always consult an appropriate professional electrician or plumber. Always read and follow any relevant manuals and safety instructions. When working with electricity, always turn off the mains. In connection with building, www.OzFlatPacks.com.au cannot advise on planning permission or building regulation issues. The customer is responsible for obtaining all necessary planning permission and local authority consents and permissions for any work to be carried out.

 

Returns policy:

As all our cabinetry is custom made to your requirements, there is a 'no returns' policy available (as we can't just 'put it back on the shelf for someone else'), so please double check all the details before paying the deposit.

 

Faulty / lost / damaged items:

If you have any problems with your purchase, we can offer help and assistance. Please contact us immediately.
Faulty Items - The cabinetry is supplied with a 7 year guarantee. In the unlikely event of a defect in manufacturing or raw materials, we will replace the faulty item for you. Appliances are sold as per the manufacturer’s warranty and in the event of a fault, please contact the manufacturer directly.
Lost / Damaged Items - If any items were lost or damaged in transit, we ask that you report it to us within 2 working days. Any claims after this period will not be accepted. If the items are visibly damaged on receipt, it’s best to sign the carrier’s delivery note accordingly.
If a fault is caused by accident, misuse or negligence on your behalf, or it occurs outside the guarantee period, it will not be covered.
Nothing in section "Faulty / lost / damaged items:" affects your statutory rights.

 

Payments:

Payment can be made by Mastercard, Visa Card or Direct Transfer. Please note: We do not accept any card issued outside of Australia.
Your credit card details will be encrypted by our payment gateway through St George, to minimise the possibility of unauthorised access or disclosure. Written authority for credit card payment must be given at the time of order. If there is a problem taking payment for all or part of your order, we will contact you by telephone or email.

 

General:

You may not transfer any of your rights under these Product Terms & Conditions to any other person. If you breach these Product Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date, or in any other situation where you breach these Product Terms & Conditions. We shall not be responsible for any breach of these Product Terms & Conditions caused by circumstances beyond our reasonable control. Except as expressly set out in these Terms & Conditions, all use of your personal information will be made in accordance with our privacy policy. These Product Terms & Conditions are subject to Australian law. We will try to solve any disagreements quickly and efficiently.
